ZINGPOINTS! - Terms and Conditions

- General Overview. The Golfzing Rewards Program (the program) is an incentive-based rewards program that awards "Points" to www.golfzing.com ("website") registered users ("members") who use the Website to reserve a tee time. By using the Website to reserve a tee time, you agree to be bound by these Terms and Conditions. Sponsor will be referred to in these Terms and Conditions as "sponser", "we", "us" and "our". - Eligibility. The Program is open to all Members who are of the age of majority in the state where they reside and who (i) reserve a tee time through the Website (a "Reservation") or (ii) are a Registered Player (each a "Participant", collectively, "Participants"). Only Participants are eligible to receive Points.
- Earning Points.
- Participants are eligible to earn Points when they make a Reservation and check-in for the Reservation. Points will not be awarded (i) if Participants do not check-in for their Reservation; (ii) for Reservations that are subsequently cancelled for any reason whatsoever or (iii) for tee times booked via phone or in person. The Website will show the Reservation Points value at the time of booking. Failure to check-in for a Reservation may also result in a no-show fee being charged to the booking credit card.
- Participants that make a Reservation for two, three or four players can add Golfzing "friends" to their Reservation (each, a "Registered Player") by choosing their friend’s name from a drop-down menu at the time of booking. Registered Players are also eligible to receive Points for the Reservation upon check-in. All Participants must show valid identification upon check-in to be eligible to receive their Points. Participants are not permitted to accumulate Points for other players or Members.
- Points will be credited to each Participant’s account within 24 hours of check-in. The Website reservation system shall be the sole determination of Reservations and check-ins by Participants.
- Point Balances/Redeeming Points/Additional Fees.
- Participants can view their Point balance in their profile box when they log into the Website. If you believe that your Points balance is incorrect, please contact Golfzing Rewards Program Customer Service at the contact information below. We may request that you provide additional information, such as a receipt, to determine what change, if any, should be made to your Point balance. However, please note that any dispute regarding Point balances will be resolved by us, at our sole discretion, without right of appeal or hearing by you.
- Points earned can be redeemed for rounds of golf booked through the Website ("Points Reservations"). All Points Reservations are subject to availability. To redeem Points, just check the "Use Reward Points" box on the payment page when making your reservation. The number of Points required for a Points Reservation will vary based on the day of the week and the time of day. All Website available tee times will list the number of Points required per player for a Points Reservation. Participants may redeem their Points for rounds for other players, provided that the booking Participant has the requisite number of Points.
- A .99 cent reservation fee per person will be charged on all Points Reservations. Points Reservations are non-refundable. Points will be deducted from the Participant’s account immediately upon successful booking of a Points Reservation. Any Points Reservation may be cancelled by us for any reason, and in such case your Points will be returned to your account.
- Participants are personally responsible for any and all federal, state and/or local taxes, if any, resulting from Points Reservations. No cash alternative will be offered in exchange for Points. Points accrued in the Program are not considered your property and are not transferable or exchangeable for alternative rewards. Points cannot be purchased, sold, transferred, or assigned for any reason without specific written consent of Sponsor, which consent may be withheld for any reason.
- Points Expiration. Points do not expire provided that you book at least one tee time in a calendar year. If you do not book a tee time within a calendar year, Points will be subject to expiration two years from the date they were earned. It is your sole responsibility to use your Points that may expire due to inactivity as well as to determine when the expiration deadline will be for you. The specific local time of the expiration will be based on your registered account location.
- Account Cancellation. We have the right to terminate your participation in the Program if you breach these Terms and Conditions and in such case any and all Points earned will be forfeit. You may request that we reactivate your participation in the Program, but it will be up to us whether to allow you to participate again. If we reactivate your account, crediting you with your previous Point balance will be at our sole discretion.
- Log-in/Password. Your Website log-in and password information is personal to you and should be kept confidential. You should immediately notify us if you find out about or suspect there is unauthorized use or if you have any security concerns in any way associated with your log-in and password, because until you do so, you are and remain solely responsible and liable for any activity, authorized or not, costs, charges or other consequences stemming directly or indirectly from the use of your log-in and password.
- Termination of the Program. We reserve the right to terminate the Program at any time with or without prior notice to you. Any notice, if applicable, will be by email to the address you submitted on registration for the Website and/or Program. We will not be liable in the event that you do not receive or see any such email notification. It is your responsibility to ensure that you have provided the correct email address and to check your email and server. In addition, any notice of termination will be published on the Website. In the event that any notice has been given in respect of the termination of the Program, you will be notified of the timeframe in which you must use the Points you have accumulated against rewards available. After such time, the Points that have not been used will be eliminated.

- Privacy Policy and Website Terms and Conditions. All information obtained through your participation in the Program is subject to the Website privacy policy, a copy of which can be found at http://www.golfzing.com/privacy-and-usage. Your use of the Website is subject to the Website Terms of Use, a copy of which can be found at http://www.golfzing.com/terms-of-use.
- Limitation of Liability. Under no circumstances shall we be liable for any direct, indirect, incidental, special or consequential damages that result from: (i) your use of or inability to use the Website, including but not limited to reliance by you on any information obtained from the Website that results in mistakes, omissions, interruptions, deletion or corruption of files, viruses, delays in operation or transmission, or any failure of performance; (ii) your accruing of Points; or (iii) your participation in the Program, use or misuse of any reward received through participation in the Program, including but not limited to death or personal injury stemming from such use. The foregoing Limitation of Liability shall apply in any action, whether in contract, tort or any other claim, even if our authorized representative has been advised of or should have knowledge of the possibility of such damages. You hereby acknowledge that this paragraph shall apply to all content, merchandise and services available through the Website. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
- Indemnification. You agree to defend and/or handle at your own cost and expense any third party claim, action and/or proceedings against Sponsor and all of their respective agents, directors, officers, employees, information providers, licensors and licensees, affiliates and subsidiaries, (collectively, "Indemnified Parties") based upon or arising out of any breach of by you of these Terms and Conditions ("Claim") and you further agree to indemnify and hold harmless the Indemnified Parties from and against any and all liabilities, losses, damages, costs and expenses (including reasonable attorneys’ fees and expenses) associated with any such Claim. Sponsor reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and you agree to cooperate as fully as reasonably required in our defense of any claim. You shall not in any event settle any matter without the written consent of Sponsor.
- General Terms. Any claim relating to the Program shall be governed by the internal substantive laws of the State of California, United States of America. Any cause of action you may have with respect to your involvement in the Program or use of this Website must be commenced within (1) year after the claim or cause of action arises. If for any reason a court of competent jurisdiction finds any provision of these Terms and Conditions, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to affect the intent of this agreement, and the remainder of these Terms and Conditions shall continue in full force and effect.
